Spam is something no-one wants cluttering up their inbox. At best it’s irritating to receive and pointless to send - at worst sending it can land you a fine of up to £5,000 (or even higher if the case goes before a jury) and ruin your company’s professional reputation in your marketplace.
email is a proven successful marketing medium and it’s our business to help you interface with as many of your customers and potential customers as possible, but there are rules to follow and legal requirements to meet for all emailers, particularly when you are emailing private individuals. We don’t want you to run the risk of damaging your hard won reputation so we do require your confirmation that each database you use contains only permission based email addresses.
By registering for an account and agreeing to our terms and conditions for use you are also agreeing to this anti-spam policy.
1 What is spam?
Spam is unsolicited email sent in bulk. Any promotion, information or solicitation that is sent to a person via email without their prior consent, where there is no pre-existing relationship between the sender and the recipient, is classed as spam.
2 What is permission based marketing?
Acceptable, permission based email marketing is where your intended email recipients have:

supplied their details to you previously via an email newsletter or other online subscription, or enquiry form on your website.

completed an offline form such as a competition or survey where they have indicated they would like to be contacted about your products and services.

given you their contact details at a trade show or other event or perhaps via a mutual acquaintance knowing you would be in contact with them.

purchased from you previously.
3 Basic rules

Every email we send on your behalf must be on ‘opt in’ communication where you have been given permission to send information to your recipient’s email address. You will need to put in place checks to ensure your mailing lists meet this criterion.

All emails must show your full contact details including company name, registered address and number if applicable, and at least an email address and phone number for query/enquiry.

Every email must also include an ‘unsubscribe’ link which allows recipients to tell you they no longer wish to receive emails from you by simply clicking on the link. Any contacts that have used this ‘unsubscribe’ option must then be deleted from your database to avoid the possibility of resending.
These are legal requirements.
The first is your responsibility as the data controller under data protection law. We will provide you with an online subscription box which you can add to your website which will help you enforce the ‘opt-in’ nature of your newsletters and promotional emails.
We will ensure every email we send on your behalf meets the last two requirements (based on the information that you have supplied us) and that any ‘unsubscribes’ to your campaigns are removed from your mailing list so you don’t have to worry that your emails may not comply. Please note that the User is solely responsible for maintaining the accuracy of its registration and contact details.
4 Email campaign checks
To avoid any nasty surprises for either of us we will sample check email campaigns prior to sending. This will include monitoring content against standard protocols and verifying large email list imports. Bounce back rates will be checked continually and any significant level of complaint recorded (in excess of prorata 5 per 2,000 campaign recipients) will mean your account will be suspended and potentially terminated.
5 Abuse
Abuse of this anti-spam policy will lead to immediate suspension of services to you and potential termination of your emailing account with us.
In the end, it’s really common sense. Take off your marketing hat and put yourself in your recipient’s shoes. If they don’t recognize who you are or aren’t interested in what you’re sending, they’ll think you’re a spammer. It’s that simple.
